What to expect
- Duration
- A case usually passes through two or three court instances. Where the courts carry a normal caseload, each instance takes on average about one year until judgment.
- What causes delay
- The overall length depends on whether the party dissatisfied with the judgment decides to appeal, and on the current caseload of the court concerned.
Costs
Court proceedings involve significant outlay, including:
- State fees — usually 4% of the value of the claim at first instance.
- Attorney’s fees for each instance.
- Costs of court-appointed expert opinions, witnesses and other procedural steps.
